1. Eligibility
The “Win The Entire Top
20®” Sweepstakes (the "Sweepstakes") is open only to legal residents
of Canada (excluding the Province of Quebec) and the fifty (50) United States
(including District of Columbia) who have reached the age of majority in their
respective jurisdiction at the time of entry. Void in Guam, Puerto Rico, the
U.S. Virgin Islands, and other U.S. territories and possessions and where
prohibited by law. Employees, representatives, officers and directors of Travelzoo (the “Sponsor”),
Launchfire, Inc. (“the Administrator”), and other companies associated with the
Sweepstakes, their parents, subsidiaries, affiliates, agents, advertising
agencies, promotional suppliers, and the immediate family members (spouse,
parents, siblings, children, and life partner) and household members (people
who share the same residence at least three (3) months out of the year) of such
employees, officers and directors are not eligible to participate or win.
Participation constitutes entrant's full and unconditional agreement to these
Official Rules and Sponsor and Administrator's decisions, which are final and
binding in all matters related to the Sweepstakes. Winning a prize is
contingent upon fulfilling all requirements set forth herein.
2. Timing
The Sweepstakes begins
on June 2, 2008 at 9:00 am Eastern Time ("ET") and ends on September
1, 2008 at 8:59 am ET (the “Sweepstakes Period"). The Administrator's
computer is the official time keeping device for this Sweepstakes.
3. How to Enter
NO PURCHASE NECESSARY TO ENTER OR WIN. To enter the Sweepstakes, visit the Sweepstakes web site
located at http://sweepstakes.travelzoo.com (“Sweepstakes Site”) during the
Sweepstakes Period. There are five (5) ways to receive entries into the
Sweepstakes during the Sweepstakes Period:
ENTRY METHOD #1 – You can receive two (2) entries
into the Sweepstakes by registering for the Sweepstakes on the Sweepstakes
Site. To register for the Sweepstakes, you must complete and submit a
registration form containing your full name, email address, postal code, and
any other information requested by Sponsor. By registering for the Sweepstakes,
you are also agreeing to receive the Top 20® List email from Sponsor (if you
are not already a Top 20® List email subscriber). You may only register for the
Sweepstakes once. You can opt-out of receiving the Top 20® List email at any
time by visiting http://www.travelzoo.com/profiles. UNSUBSCRIBING TO THE TOP
20® LIST EMAIL WILL NOT IMPACT YOUR CHANCES OF WINNING;
ENTRY METHOD #2 – You can receive entries into the
Sweepstakes by logging in to the Sweepstakes Site. You will receive one (1)
entry for each day you log on to the Sweepstakes Site. You will not receive
additional entries if you log on to the Sweepstakes Site more than one time per
day. You may receive up to ninety one (91) entries into the Sweepstakes through
this entry method;
ENTRY METHOD #3 – You can receive entries into the
Sweepstakes by logging in to the Sweepstakes Site and playing a short game
(“Game”). You will receive one (1) entry for every five (5) times you log on to
the Sweepstakes Site and play the Game. You may receive up to thirty-five (35)
entries into the Sweepstakes through this entry method;
ENTRY METHOD #4 – You can receive up to one hundred
twenty five (125) entries into the Sweepstakes through either of the following
ways:
A. You can receive entries into the Sweepstakes
through the Tell-A-Friend entry method by clicking on the “Invite a Friend”
link on the Sweepstakes Site. You may submit the names and email addresses of a
total of up to twenty five (25) friends who must be eligible to enter the
Sweepstakes. You will be asked to provide your email address (you should use the
email address you used to register for the Sweepstakes) and your friends’ email
addresses on the referral page of the Sweepstakes Site. The referral email will
include a standard message inviting your friends to enter the Sweepstakes and
include a URL link to the Sweepstakes Site. You may only refer persons with
whom you have an existing relationship and from whom you have received
permission to provide their email addresses to Sponsor. For each referral with
a valid and unique email address, you will receive five (5) entries into the
Sweepstakes for each referred friend who visits the Sweepstakes Site and
registers for the Sweepstakes during the Sweepstakes Period, using the link
contained within the email he/she received from you through this entry method.
You will not receive additional entries for inviting the same friend more than
once or if a referred friend registers for the Sweepstakes more than once using
the link they receive.
B. You can also receive entries into the
Sweepstakes by providing a personal web link (“Personal Link”) to third parties
who can click on your Personal Link to access the Sweepstakes Site. To retrieve
your Personal Link, click on “Personal Link” in the ‘Entry Checklist’ box on
the Sweepstakes Site. You will earn five (5) entries for every person who is
directed to the Sweepstakes Site using your Personal Link and registers to
enter the Sweepstakes. You will not receive additional entries if the same
person uses your Personal Link to visit and registers for the Sweepstakes more
than once. The distribution of your Personal web Link is at your discretion,
subject to the following: Sponsor reserves the right to cancel and void any
Personal Link and all associated Entries which it deems, in its sole discretion
to be used or associated with content which is deemed inappropriate. Without
limiting the foregoing such content includes all forms of pornography,
inappropriate language and content that incites hate, is demeaning, depreciates
the value of the Sponsor’s brand name, or incites discrimination of any and all
forms; and
ENTRY METHOD #5 – You can receive entries into the
Sweepstakes by answering the weekly “Top 20 Question” (“Question”) posted on
the Sweepstakes Site. You will receive five (5) entries per week by submitting
an answer to the Question. The Question will change each week. You may receive
up to sixty five (65) entries through this entry method.
LIMIT - MAXIMUM OF 165 ENTRIES PER ENTRANT REGARDLESS OF
ENTRY METHOD. All
Entries become the property of Sponsor and will not be returned or
acknowledged. Sponsor is not responsible for lost, late, incomplete, invalid,
unintelligible or misdirected registrations, which will be void. Any attempt by
any entrant to obtain more than the stated number of entries by using multiple/different
email addresses, identities, registrations and logins, or any other methods
will void that entrant's entries and that entrant may be disqualified. Use of
any automated system to participate is prohibited and will result in
disqualification. Multiple entrants are not permitted to share the same email
address. In the event of a dispute as to any registration, the authorized
account holder of the email address used to register will be deemed to be the
registrant or player. The "authorized account holder" is the natural
person assigned an email address by an Internet access provider, online service
provider or other organization responsible for assigning email addresses for
the domain associated with the submitted address. Potential winners may be required
to show proof of being the authorized account holder.
4. Winner Selection: Sponsor will conduct random drawings to select
potential winners for weekly prizes and grand prizes as described in detail
below:
- WEEKLY DRAWING: Sponsor or its agent will select one (1)
potential weekly prize winner for each of the thirteen (13) weeks of the
Sweepstakes Period for a total of thirteen (13) weekly winners. A “week”
is defined as starting on Monday at 9:00 am ET and ending on the following
Monday at 8:59 am ET. Weekly winners will be selected for the following
weeks:

Week One: June 2, 2008 (9:00 am ET) through
June 9, 2008 (8:59 am ET).

Week Two: June 9, 2008 (9:00 am ET) through
June 16, 2008 (8:59 am ET).

Week Three: June 16, 2008 (9:00 am ET) through
June 23, 2008 (8:59 am ET).

Week Four: June 23, 2008 (9:00 am ET) through
June 30, 2008 (8:59 am ET).

Week Five: June 30, 2008 (9:00 am ET) through
July 7, 2008 (8:59 am ET).
·
Week Six: July 7, 2008 (9:00 am ET) through
July 14, 2008 (8:59 am ET).
·
Week Seven: July 14, 2008 (9:00 am ET) through
July 21, 2008 (8:59 am ET).
·
Week Eight: July 21, 2008 (9:00 am ET) through
July 28, 2008 (8:59 am ET).
·
Week Nine: July 28, 2008 (9:00 am ET) through
August 4, 2008 (8:59 am ET).
·
Week Ten: August 4, 2008 (9:00 am ET) through
August 11, 2008 (8:59 am ET).
·
Week Eleven: August 11, 2008 (9:00 am ET)
through August 18, 2008 (8:59 am ET).
·
Week Twelve: August 18, 2008 (9:00 am ET)
through August 25, 2008 (8:59 am ET).
·
Week Thirteen: August 25, 2008 (9:00 am ET)
through September 1, 2008 (8:59 am ET).
For each
of the above listed thirteen (13) weeks of the Sweepstakes Period, one (1)
potential winner will be selected by a random drawing from all the eligible
entries received through that week on or about September 4, 2008.
- GRAND PRIZE DRAWING: On or about September 4,
2008, one (1) potential 1st Grand Prize Winner will be drawn
randomly from all eligible entries received during the Sweepstakes Period.
Weekly Winners are eligible to win the Grand Prize Drawing.
5. ALL
POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR AND
ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO
THE SWEEPSTAKES.
6. Verification of Potential Winners
Potential winners must
continue to comply with all terms and conditions of these Official Rules, and
winning is contingent upon fulfilling all requirements. The potential winners
will be notified by email within thirty (30) days from the date(s) of random
drawing. The potential winners may be required to sign and return to
Administrator or Sponsor, within twenty one (21) days of the date notice is
sent, an affidavit of eligibility and liability/publicity release (except where
prohibited) in order to claim his/her prize. If a potential winner of any prize
cannot be contacted, does not respond to the notification attempt within seven
(7) days from the first notification attempt, fails to sign and return the
affidavit of eligibility and liability/publicity release within the required
time period (if applicable), or if the prize or prize notification is returned
as undeliverable, the potential winner is disqualified and forfeits the prize.
In the event that a potential winner is disqualified for any reason, Sponsor
will award the applicable prize to an alternate potential winner by random
drawing from among all remaining eligible entries.
FOR RESIDENTS OF CANADA ONLY:
Before
being declared a winner, if the potential winner is a legal resident of Canada,
he or she must correctly answer a time-limited mathematical skill-testing question,
without assistance of any kind, whether mechanical or otherwise, provided by
Sponsor via email. The potential winner must correctly answer the time-limited
mathematical skilled testing question and send the answer to Sponsor within
twenty four (24) hours of Sponsor sending the question by email to the
potential winner. The answer must be faxed to: Travelzoo, Attention:
Sweepstakes at (312) 768-6101. If Sponsor does not receive the answer within
the specified time period, the potential winner forfeits the Prize and Sponsor
may conduct another random drawing of all remaining eligible Entries to select
an alternate potential winner.
7. Prizes
GRAND
PRIZE: The Grand
Prize Winner will receive the choice of one of the following prizes:

The
opportunity to enjoy all of the travel offers described in the Travelzoo Top
20® List for the week of August 27, 2008,
subject to availability. Approximate Retail Value (“ARV”) of the Grand Prize:
USD $5,969.00.

2.
A cash
prize of USD $5,000.00.
WEEKLY
PRIZES: Thirteen
(13) Weekly Winners will each receive the choice of one of the following
prizes:
1.
The
opportunity to enjoy one (1) of the travel offers described in the Travelzoo
Top 20® List for the week of August 27,
2008, subject to availability. ARV for each Weekly Prize: USD $500 each.
Total ARV of all Weekly Prizes: USD $ 6,500.

2.
A cash
prize of $500.00.
TOTAL ARV OF ALL PRIZES: USD $12,469.
For All Prizes: LIMIT - ONE WEEKLY PRIZE PER PERSON. Weekly Winners are
eligible to win the Grand Prize. Odds of winning a prize depends on the number
of eligible entries received during the Sweepstakes Period. Prizes are
non-transferable and no substitution will be made except as provided herein at
the Sponsor's sole discretion. Sponsor reserves the right to substitute any
listed prize for one of equal or greater value for any reason or to provide a
winner with the cash value of the lowest advertised amount of the selected
travel offer(s). Winners are responsible for all taxes and fees associated with
prize receipt and/or use. Sponsor’s use of third-party trademarks does not
imply that any third party endorses, sponsors or is otherwise affiliated with
Sweepstakes. Any and all guarantees and warranties are subject to the
manufacturer's or service provider’s terms and conditions, and winner agrees to
look solely to such entity for any such warranty or guarantee claim. All
monetary amounts listed in these Official Rules are in US Dollars.
See individual travel
offers for terms and conditions, including travel restrictions such as blackout
dates and occupancy restrictions. Each travel offer is subject to availability
and restricted to the dates outlined on the specific travel offer page. If a
travel offer includes more than one option, each winner must provide Sponsor
with his or her selection for that offer and Travelzoo will make all reasonable
efforts to accommodate such selection. All hotel offers are limited to the
number of nights and occupancy restrictions listed in the travel offer, all
airline flight offers are limited to the number and type of airline tickets
specified in the travel offer, and all holiday offers are limited to the
duration and occupancy requirements specified in the travel offer. If a travel offer is booked by Sponsor but a
winner does not utilize such booking or a winner does not book a travel offer
through Sponsor during the travel period outlined on the specific travel offer
page, the prize is null and void and no further compensation or prizes will be
offered. It is highly recommended that winners book his or her desired travel
dates upon confirmation of winning a prize. SPONSOR MAKES NO WARRANTIES,
EXPRESS OR IMPLIED, AS REGARDS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE REGARDING THE PRIZE.
8. Release
and Publicity
By accepting a prize,
winners agree to release and hold harmless Sponsor and their respective
subsidiaries, affiliates, suppliers, distributors, advertising/promotion
agencies and each of their respective parent companies and each such company's
officers, directors, employees and agents (collectively, the "Released
Parties") from and against any claim or cause of action, including, but
not limited to, personal injury, death, or damage to or loss of property,
arising out of participation in the Sweepstakes or receipt or use or misuse of
any prize. Except where prohibited, participation in the Sweepstakes
constitutes winners consent to Sponsor's and its agents' use of winner's name,
likeness, photograph, voice, opinions and/or hometown and state for promotional
purposes in any media, worldwide, without further payment or consideration.
9. General Conditions
Sponsor reserves the
right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if
any fraud, technical failures or any other factor beyond Sponsor's reasonable
control impairs the integrity or proper functioning of the Sweepstakes, as
determined by Sponsor in its sole discretion. Sponsor reserves the right in its
sole discretion to disqualify any individual it finds to be tampering with the entry
process or the operation of the Sweepstakes or to be acting in violation of
these Official Rules or any other promotion or in an unsportsmanlike or
disruptive manner. Any attempt by any person to deliberately undermine the
legitimate operation of the Sweepstakes may be a violation of criminal and
civil law, and, should such an attempt be made, Sponsor reserves the right to
seek damages from any such person to the fullest extent permitted by law.
Sponsor's failure to enforce any term of these Official Rules shall not
constitute a waiver of that provision.
10. Limitations of Liability
The Released Parties
are not responsible for: (1) any incorrect or inaccurate information, whether
caused by entrants, printing errors or by any of the equipment or programming
associated with or utilized in the Sweepstakes; (2) technical failures of any
kind, including, but not limited to malfunctions, interruptions, or
disconnections in phone lines or network hardware or software; (3) unauthorized
human intervention in any part of the entry process or the Sweepstakes; (4)
technical or human error which may occur in the administration of the
Sweepstakes or the processing of entries; or (5) any injury or damage to
persons or property which may be caused, directly or indirectly, in whole or in
part, from entrant's participation in the Sweepstakes or receipt, use or misuse
of any prize. If for any reason an entrant's entry is confirmed to have been
erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy
is another entry in the Sweepstakes, provided that if it is not possible to
award another entry due to discontinuance of the Sweepstakes, or any part of
it, for any reason, Sponsor, at its discretion, may elect to hold a random
drawing from among all eligible entries received up to the date of
discontinuance for any or all of the prizes offered herein. No more than the
stated number of prizes will be awarded.
11.
Disputes
Entrant agrees that:
(i) any and all disputes, claims and causes of action arising out of or
connected with this Sweepstakes, or any prizes awarded, other than those
concerning the administration of the Sweepstakes or the determination of
winners, shall be resolved individually, without resort to any form of class
action; (ii) any and all disputes, claims and causes of action arising out of
or connected with this Sweepstakes, or any prizes awarded, shall be resolved
exclusively by the United States District Court or the appropriate New York
State Court located in New York, New York (iii) any and all claims, judgments
and awards shall be limited to actual out-of-pocket costs incurred, including
costs associated with entering this Sweepstakes, but in no event attorneys'
fees; and (iv) under no circumstances will entrant be permitted to obtain
awards for, and entrant hereby waives all rights to claim punitive, incidental
and consequential damages and any other damages, other than for actual
out-of-pocket expenses , and any and all rights to have damages multiplied or
otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR
EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
MAY NOT APPLY TO YOU. All issues and questions concerning the construction,
validity, interpretation and enforceability of these Official Rules, or the
rights and obligations of the entrant and Sponsor in connection with the
Sweepstakes, shall be governed by, and construed in accordance with, the laws
of the State of New York, without giving effect to any choice of law or conflict
of law rules (whether of the State of New York or any other jurisdiction),
which would cause the application of the laws of any jurisdiction other than
the State of New York.
12. Entrant's Personal
Information
Sponsor will collect
and use personal information submitted by entrants for the purposes of
administering this Sweepstakes and for the purpose of administering entrant
subscription to the List. Please review Sponsor’s privacy policy at http://sweepstakes.travelzoo.com/privacy.
By participating in the Sweepstakes, entrants hereby agree to the management of
their personal information, as explained in Travelzoo's privacy policy.
For this Sweepstakes,
Launchfire, Inc., a third party unrelated to Travelzoo, will collect personal
information about entrants solely for the purpose of the administration of this
Sweepstakes. Entrants’ personal
information will not be distributed to any other company, organization or
individual, except to the Sponsor and for the operation and fulfillment of this
Sweepstakes.
13. Official Rules / Winners
List
Sponsor will post the
Official Rules and the name and city of the winners on the web site located at http://sweepstakes.travelzoo.com/winners,
and will maintain the winners list for approximately six (6) months after the
drawing.

nor have endorsed this Sweepstakes. Winners bear all responsibility for use of
prizes in compliance with the terms and conditions imposed by the travel
provider and any additional costs associated with the use of such prizes.
